Selling a used item as brand new is not ok

So I bought a used one and a brand new one in order to have one for play and one for collection. See the pictures, the one I paid full price for, which was sold to me as "brand new" is actually in a way worse condition. The box is clearly been opened, damaged and repacked and taped up.
