死刑廃止の問題は本質的に心の問題であるとしつつ、その最大の論拠を誤判としています。
私は廃止論者ではありませんが、最高裁判事の経験から冤罪による誤判の可能性について記述している部分には大変納得させられます。
存置論者も廃止論者も必読の一冊。
団藤先生の他の著書にもいえる事ですが、美文で非常に読みやすいです。

4.0 out of 5 stars 冤罪の視点からの記述についてはトップクラス, 2006/8/10
著者は東京大学名誉教授、元最高裁判所判事。

無罪の人間を死刑にしてしまうことを完全に避けることは
「刑法の構造上、絶対に不可能」だという点について詳しく記述してある。
冤罪という視点からの考察については最もレベルが高い本。
それ以外の部分については、著者は一流の刑法学者なのでもちろん十分に書かれていますが、
他の刑法学者によって書かれた死刑廃止論の本でも代用できる平凡な内容です。

冤罪は死刑論の中では本質的ではないという意見は多いし、それは確かにそうなのですが、
実際に裁判に関わる立場の人間から見れば非常に切実な問題なのでしょう。
人間が間違いのない判決を出すことは絶対に不可能なので、
常に冤罪の危険性を考慮し、死刑のような
取り返しのつかない刑を行ってはいけないというのは理解できます。

元最高裁判所判事の団藤先生が書いた死刑廃止派の本です。

存置派の本ばかり読んでたので、廃止派の本も読もうと思い
団藤先生の本をチョイスしました。

文章はとても読みやすく、法律の素人でも分かりやすかったです。
ただ、講演で話した事が書かれてるので仕方ないですが、
何度も同じような内容が出てきて退屈でした。
また、もっと説得させられるかなぁ？と期待してたのですが、
基本は冤罪の事中心で(←もちろん恐ろしい事ですが)
もうちょっと、被害者サイドについての見解も知りたかったです。
