法学部卒の同僚に勧められて読んだ本です。
法律を正式に勉強していない人間が、法律をどのように扱うとよいかの基本だと教えられました。
権利を主張し続けることが、法律を維持するための基本的な行動であること。
法律は支配のための道具ではなく、支配者の横暴を許さないための道具であるいこと。
法律がすべてではないこと。

公務員必携であるだけでなく、選挙権のない人も含めて、すべての国民の必携の書だと思います。
復刻したので、多くの人に読んでもらえるようになったことは喜ばしいことだと思います。

自己の権利が侵害された際に法廷等で徹底して闘うことは、単なる損得勘定の問題ではなく、自己の尊厳を回復するための倫理的自己保存であり、法を実現するための共同体に対する義務であると説いた情熱の書。

和をもって尊しとなし、訴訟を嫌う日本人にとって、西欧精神の極みである本書の主張は衝撃的であったらしく、西周により邦訳されて以降、法学部生の必読書として読み継がれている。英語圏ではほとんど読まれないことを思うと興味深い現象である。

余裕があれば、川島武宜「日本人の法意識」（岩波新書）や中島義道「ウィーン愛憎」（中公新書）と併読することを勧める。特に後者は西欧人の「権利感覚」が日常の中でどのように発現するか分かり面白い。

村上淳一の翻訳は躍動感あふれる名訳である。

　本書は、100年以上前の著作であり、著者の思想を現代の、しかも日本でそのまま受け入れることはできない。また、分量も少なく、訳も洗練されているため、すらすらと読みこなせるがゆえに、一見著者の「権利のための闘争」という主張は、少々過激に聞こえるかもしれない。
　しかし、権利侵害は、単なる物質的・金銭的侵害にとどまらず、被侵害者の人格侵害であるという主張には共感できる面も少なくない。さらに、その回復のために国家は市民の自由を保障すべきである、という著者の主張には、説得力がある。　
　文章も平易なので、法学の初学者にもお勧めである。また、特に詰め込み式で法律を学びがちな司法試験生にも是非読んで頂きたい。著者の思想に賛成するかは別として、権利＝法とは何かを本書によって改めて考えさせられるであろう。それゆえ、本書は現代に残る法学の不朽の名作なのである。
