少年非行がニュースに取り上げられるたびに「動機は謎」「心の闇」などという言葉が飛び交います。
この点，家裁調査官である著者は，大人に理解しかねる少年の行動について，たんなる性格のかたよりでは済ませられない医学的な問題を指摘しています。
治療の対象としてケアすべき少年を，ただただ矯正施設（少年院など）に入所させているようなことがあれば，少年司法はまだまだやるべきことがある，ということになりそうです。
時を同じくして，『悲しみの子どもたち-罪と病を背負って』（岡田尊司・集英社新書），『発達障害と子どもたち　アスペルガー症候群，自閉症，そしてボーダーラインチャイルド』（山崎晃資・講談社＋α新書）といった，医師による少年非行関連図書が刊行されています。
「アスペルガー症候群や自閉症の子どもは非行を犯しやすい」といった考えは誤っている，と著者らは言います。
そうした子どもたちへの接し方を「大人が」誤ると，少年非行が生み出されてしまう，というのが真相のようですよ。

犯罪を犯してしまう要因は様々なものが絡みあっています。心理学的要因、社会学的要因などに特に注目されてきましたが、著者は生物学・医学的要因があることを強く訴えています。なんと脳にも問題があるのだそうです。
脳というのはまだまだ解明されてなくて、興味深いです。犯罪という現象はそれだけ単純に説明できるものではないのだと、改めて痛感しました。

「異常な犯罪を起しているのは、アスペルガーですよ。」と各事件で繰り返して書くのは、間違っている。それを「私は、発見した。」みたいに書くのはいかがなものか。アスペルガー症候群イコール異常犯罪者のように見えてしまい、読者や社会に誤解を招く。この世の中、アスペルガー症候群の人はたくさんいる、一生懸命生きている人たち、素直に生きている人たちに偏見をもたらすということは、ペンを持つ人間として気を配らねばならない。
「家裁調査官と言われても、その仕事を正しく理解している人がいない」と作者は、うたっている。所詮裏方的な自分を前に出して、こんなに大変でりっぱなことをしているんです。と言いたいだけに思えた。
