5.0 out of 5 stars 商標法3条と4条は本書が決定版, 2006/1/29
「法律学」として商標法を勉強したい方はともかく、実務や弁理士試験においては、3条と4条については本書+特許庁逐条解説（青本）で必要十分ではないかと思います。実例が多くて読みやすいです。
また、商標審査基準は意外とそっけない（結論だけで理由が書かれていない）記載が多いので、本書で理由を理解していないと覚えるのに苦労します。

　元特許庁職員の著者が、商標法についての特許庁での内部運用基準「商標審査基準」を、判例や実際に登録になった(拒絶になった）出願を例に、わかりやすく解説しています。
　特に4条に係る基準ついては、それだけで300ページ弱が割かれており、各号についてみっちりと説明がされていて、よく理解できます。、3条についても詳しいです。(その他7、8、10、64条等)

　個人的には、「これでもか！」とばかりの豊富な事例を交えた詳しい説明に、味気ない条文に秘められた熱い思い(？)が汲み取れ、興味を持つことができました。様々な商標が参考として載せられているので、ビジュアルも少しあり、飽きずに読めて面白かったです。

商標法の審査基準は簡潔に記載されていることが多いので、その背景や実例が盛り込まれた本書を読めば、具体的なイメージが沸きやすく、審査基準の理解の助けになると思います。
