元高裁判事の書かれた本。裁判所の研修でテキストとして使用されているという話を聞いたことがあります。裁判官がどういう考え方で判断するのかを知ることは実務上重要です。
裁判官がどのような判例を先例として判断するのか、本書が大いに参考となります。

弁理士試験の論点を集めています。論点に走ると合格が遅れるといいますが、拾い読みすればよいと思います。特に、下記は必読だと思います。

・間接侵害の等価説
・平成１８年には意匠法の3条1項の類似の改正があります。判例が整理されており、創作説の批判のもと、筆者が混同説を支持する根拠と類否判断が記載されています。高田が絶版になった今、この本の記載は混同説のバックボーンになりそうです。
