　医療には不確実性が常に伴う。その不確実性に基づいた行為を、結果が悪かった事を理由に刑事事件として扱うことは、その医療の根本である不確実性を否定することである。医療者は患者が不確実性を理解した上で治療を受けるようにする義務があるが、その結果で刑事罰を問われることは医療の完全否定につながり、医療の発展を阻止するものである。
　世界に誇れる日本の優れたシステムとしての国民皆保険のもと、平等で比較的高水準な医療が安定して日本では行なわれている。患者の権利意識が高まる現代の中で、求められる医者、患者の倫理観が鋭く分析されている。外科医として、これからいつの日か患者となる一個人として一読すべき１冊です。

筆者渾身の「医療崩壊―「立ち去り型サボタージュ」とは何か」の前編に当たる本です。　医学界の旧弊、メディアの暴力、警察・検察の傲慢、医療行政の怠慢、これらが現場にどにようなしわ寄せをしているかが描かれています。　私は、医療崩壊を読んでから本書を読んだ関係であまり新鮮味は感じませんでしたが、間違いなく、深い洞察を含んだ良書です。　しかし、どちらか一冊というのであれば躊躇無く、医療崩壊をお勧めします。　本著での著者の主張が、より包括的かつ仔細に述べられていると考えるからです。

慈恵医大青戸病院の腹腔鏡下前立腺手術で患者が死亡し医師が逮捕された事件の根底にある問題を指摘している．本来不確実であるはずの医療行為の結果が悪かった場合に民事ではなく刑事事件として裁かれるのは理不尽であるとして公的な医療事故調査機関の設置を提案している．また医療事故原因の根底には日本の大学医学部中心の人事制度の問題があり，臨床家として十分なトレーニングを受ける機会がなく自由な発言もできないような状況を改善すべきであると主張している．また医療者は患者の権利意識が強い時代に合う実学としての医療倫理を組織として確立することが重要であると訴えている．第一線のベテラン医師が日本の医療の問題点をあげながら，世論と医療者のそれぞれに警鐘を鳴らしている他に類をみない一読すべき優れた著書であろう
