「商標・意匠・不正競争判例百選」が出たので、その記念に書いてみます。

まず、収録判例については、重要なものはほぼ網羅されていますが、重要な判例でも漏れてしまっているのもあるので、適宜、他の判例本で補う必要はあると思います。
（例えば、商標法2条関係でBOSS事件、シャディ事件等は、百選では掲載されてますが、該判例集では掲載されていません。）

とはいえ、これだけのサイズの本で、知的財産法全てのカバーしているのはやはり魅力です。
また、百選に掲載されている事件については、クロスリファレンスが可能なように事件番号が書いてあり、理解を深めたい時などは非常に便利ですね。有斐閣の判例集ならではです。

また、いわゆる受験等の判例集は事実関係が省略されていることが多いですが、こちらの判例集では、簡単な事実も紹介されており、どのような事件での判決なのか分かるので、イメージをもって読むことができるのがいいです。

マイナスポイントは、上記のカバーし切れていない重要判例があることと、目次が見辛いことぐらいでしょうか。

次の改訂版では、最新判例のフォロー、「商標・意匠・不正競争判例百選」へのクロスリファレンスと、上記2点が解決されれば、★5確定です。

本書は、知的財産権全般にわたる重要判例が掲載されています。
判決の解説等は比較的短いかわりに判決文の判旨が長めに掲載されています。
『特許判例百選』（有斐閣）とは、全く逆の構成になっています。
判例解説本には、珍しく図入りですので、意匠法、商標法や著作権法等では、特に、判決の理解を助けてくれます。

また、著作者の茶園先生は、過去数年間、弁理士試験の試験委員をされていますので、試験委員の方がどのような判決を重要と認識しているか推測できる可能性があります。

掲載されてある判例は、特許法概説に掲載されている昔の重要判例から最新の判例まで掲載されています。

判決文の全文を読みたくない方や、判例の詳細な解説を必要としない方等には、お薦めです。
特に、弁理士試験をめざされている方には、最適と思います。
