本書は、商標法の解釈運用についての統一的な理論づけを試みたものである。その背景として、旧法の下における学説、判決例、審決例等をも可能な限りにおいて紹介することにより、現行法との関係を叙述するよう努めるとともに、工業所有権法の中でも特に国際性の高い商標法の性格にかんがみ、主要諸国の立法例との比較法的研究にも意を用いた。第6版では、マドリッド・プロトコールの実施に伴い新たに規定された改正商標法(平成11年法律第41号)中の諸条項について解説を加えるため、新たに「第9章 国際登録」の章を設けた。また、プロトコール加入に伴い強化された、登録前の商標登録出願に係る権利に関する改正規定についても所要の解説を加えた。さらに審判決例については、4~5年前以降の主要判決について掲載可能なものを審判決例のリストに加えた。
