著作権法を理解する場合の難しさは、この法律が、英米法と大陸法の、大きく二つの対立する法思想のせめぎ合いの中で出来上がっているところにある。この本は、その国際的な構造をしっかりと視座に捉えた上でわが国著作権法を解説しているので、大変わかりやすい。この二つの法思想の下で国際条約がいかにつくられてきたか、その中でわが国著作権法はどういう立場をとっているか、そういう視点から書かれている。目からうろこが落ちる待望の書。

　著者は、著作権にかかわる国際的法制度の形成に深くかかわってきた人物である。本書では、終始、わが国の著作権法制度を、国際的な視点からみつめる。
　本書は、確かに、実体法の解釈という点からは、記述の足りない部分もあるかもしれない。また、判例の引用も少ない。この点については、批判もあるのは確かである。

　しかし、私のみるところ、また、私がいうのもおこがましいことではあるが、筆者はこのことは十分に理解されている。田村概説や、作花詳説に見られるような豊潤な記述よりも、むしろ、著作権の甘いもすっぱいもかぎ分けた、円熟した学者の風格を漂わせる。瑣末な議論をあえてさけ、大きな視点から著作権法制を眺めている。こうした記述は、現在では、従来より国際的な舞台での議論!に長年かかわってきた著者のみが可能な技である。
　紆余曲折の改正を通じて形成した現在のきわめて煩雑な著作権法という法律を、ここまでシンプルに要説しうる著作権法学者は少ないだろう。複雑な事象を単純に分かりやすく説明することはもっとも難しいのである。

著作権法の概要をつかむのに最適。著作者人格権と著作権の性質が、英米、大陸法との比較法的な視点から炙り出される。判例のコメントも随所にあり、全体的に初心者にも理解しやすい説明である。
