憲法学の本としては論理性に優れると思います。憲法の学説は、総論に顕著ですが、背景となる哲学的思想の変遷や歴史的な史実を知らずして理解が困難という性格を持っています。その観点から理想的な学問のアプローチ方法としては、たとえば佐藤憲法学や伊藤憲法学のように碩学が詳細に述べられておられる原典にあたりつつ、理解を深めるというのが正しいのでしょうが、学者を目指すのでもなく、あまり時間をかけずに憲法の概要が知りたい向きにはそういう方法は採れません。その観点からすると、浦部先生は非常に論理的という点でお勧めです。芦部先生などとは異なり、前提をおかなくても、論理だけで切っていくので、背景思想や事実を知らなくても、一緒に考えていくだけで憲法の基本問題が頭に入ってくるという明瞭な効果があります。通説とは異なるという意味では、我妻説に対する内田民法学みたいに、法学ジャーナリズムの一つと捉えて読んでいても、とても面白いですし、明快です。その意味で、記述や学説自体の曖昧さを批判される芦部説や佐藤説とは異なり、論理的思考が好きな理系人種にもとてもお勧めできます。何か一冊を、と聞かれたらこれが一番だとお答えしたいと思います。

第2版は最新の問題についても、浦部教授の見解が述べられている。
やはり、通説や判例からは距離を保った、しかしとてもわかりやすい、初学者にもお勧めの一冊である。内容としても、最大限日本国憲法の問題に絞ってあり、外国憲法の話はあまり出てこないので混乱することもないと思う。その上で学説、判例をわかりやすく網羅した体系書であるといえる。
ここまで書いてなぜ星4つかといえば、浦部教授の見解および叙述が「厳格な憲法理論」ではなく、一般に受け入れられやすい「イデオロギー的」側面が強く出ていると私が感じたからだ。
しかし、だからこそ、自分で考え、批判する力も養えるかもしれない。

　明快な理論。
　妥協無き筋。
　燃える様な学者魂。
　それが浦部憲法学！！

　･･･････まあ、ゆえにどこをとっても少数説なのですが。

　それだけにホントに多数説・通説の理論的にはっきりしないところを
　ハッキリさせてくれます。
　というか「通説・判例を斬って斬って斬りまくる」といったほうがわ
　かり良いか。
　通説判例と自説をキレイに書き分けてらっしゃるので初学者でもそん
　なに危なくないかも(･････というか初学者はこんな突っ込んだ本手に
　しない)。
　
　憲法の多数説・通説は往々にして"結論の妥当性・穏当性"に肩入れし
　すぎている。
　受験生だって、時には勇気を出して、自分の正しいと思う説を採ってみ
　たい、胸のすくような、人権理念なり思想なりから一本筋の通った説
　を読んでみたい書いてみたい。
　ゼミなんかで突き詰めて考えてみると、学者の先生の言う事はなんか
　妥協しすぎてる。
「そうそう。全くその通り」と言うあなた。

　即買いです。

　若しくは図書館で「外国人の人権」とか「政教分離」の
　辺りを開いてみてください。
　ブッちゃけ惚れます。
　

　･･････とはいえこの本が司法試験等各種資格試験受験生にとっては
　"禁書"の類に入る事は間違いないでしょう。

　折衷説連発の"穏当な"芦部憲法学でしっくりきている人はよしてお
　きましょう。
