　著作権に関して書かれた本の多くは、大きく２つの種類に分類される。一つは、難しい条文を解説するもの。もう一つは著作権にまつわる争いを面白おかしく書いているものである。本書は、そのどちらでもなく、署名どおりそもそも「著作権とは何か」を文化や人間の営みの点まで掘り下げて論じている。しかし、内容は平易で分かりやすい。
　最近、著作の権利者(著作者ではない)の権利をどんどん拡大するような傾向がある。権利を拡大したほうがみんなが安心して著作が出来るから文化の発展に寄与するするのか？それとも、権利が拡大すると、新しいものが作りにくくなって文化の発展を阻害するのか？　という古くからの問題が未だに解決されていないことが分かる。また、著者の分析も見事である。
　著作権「法」ではなく、著作権そのものについて深く理解できる一冊。この値段の新書で、これだけの本が読めるのはすばらしい。

内容を単純に言ってしまえば、分かりやすい実例と、法ないし著作権解釈をひたすら語り口調で書いている本。その解釈が精緻ではないにしてもかなり的を得ている。著作権に対する導入本として、テーマ選択がうまい。軽快な語り口調も読みやすく、好感が持てる。章ごとにテーマを選び、読者に著作権の持つ問題について考えるよう促している。

無理やり難点をあげるとすれば、「著作権に関してはコレを読めば完璧」というほどの網羅性がないこと。が、新書にそれを要求するのも酷だろうと思う。

著作権という権利を曖昧にしか把握できていなかった
私にとっては非常に読みやすく、為になる本でした。
著作権法を勉強するのであれば入門書としても最適だと思います。

また、条文や判例の解釈のあり方だけにとどまらず、
現行の著作権法について、文化と創造の視点から
壮大な実験段階であると考える著者の考えに感銘しました。
