日本の司法を舞台にして、これほどの作品が書ける人は、なかなかいないと思う。一般の人は、日本の裁判についてあまり知らない。しかし著者は弁護士だ。弁護士ならではの知識とアイデアが、緊張感あふれる文章で描かれ、読者を飽きさせない。ハリウッドの法廷モノのかっこよさに感動した後は、本書で日本の裁判モノも負けてないことを実感してほしい。

現役弁護士たる中嶋博行氏の長編小説３部作の１冊。主人公は女性裁判官、それも検察官が「最高裁判所調査官」に出向しているという設定。
わが国では法律上「陪審員制度」が存在し、「停止」されていだけで、現に一時期「陪審員制度」が行われていた。その「陪審員制度」を主題にしている。主人公が仕える最高裁判所判事が殺された。検察庁、法務省、内閣情報室、警視庁がそれぞれの思惑で調査する。判事はなぜ殺されたのか？３部作中もっともスケールが大きく、和久峻三著「権力の朝」を読んだときのような興奮を覚えた。小説としての完成度は高い。おまけに、「司法行政」や「判検交流」の実態、国会による「弾劾裁判所」の方法、陪審員制度の功罪などについて教えてくれる。憲法「統治機構」の参考書としても読める。「裁判員」制度の導入を見越して執筆された、著者渾身の一作だ。

長い話でしたが、面白く読めたので長くは感じられませんでした。
少し前の話なので、小説で書かれているテーマは現在は実際に決行されることですので、陪審制が採用されるのとされない場合と決まる前に読んでいたら感想も少し違うのかなと思います。司法関係の話なので、時々分かり難いこともあったり、登場人物が読んでいて一致しなかったり私はしましたが、最後まで結末が分からず読ませるという点でも面白い小説だと思います。実際陪審制が始まったら、少し怖いような気もします。米国で実際に行われている制度のようになったら、小説でも書かれていたような裁判や判決が実際に起こりえるかもしれない、そう思って読んでいると勉強不足の一市民が陪審制で人を裁くということを、もっと真剣に向き合わなければならないと考えさせられました。
