日本はおかしなことだらけになった。
その最たるものを描いたのがこの本である。
国民のまっとうに生きる権利を奪ったものは、病気であろうとなかろうと等しく裁かれるべきである。
ところが、昨今の殺戮者たちのほとんどが簡単に弱者扱いされ、刑を免れ社会に戻ってくる。

この物語はある意味架空の話ではない。
誰にでも起こりうる恐ろしい災厄であり、もし被害者になったら誰でもこの母親のような塗炭の苦しみの中に放り出されるのだ。
あるいは、家族の誰かが、親族が、もしかしたら自分がこの犯人とおなじ加害者となる日を迎えるかもしれないのだ。
配慮を欠いた刑法が放置されているのは司法の怠慢であり、こうしたことに及び腰のマスコミや国の態度を物語は明快に責めてゆく。

物語は半ばでやや中だるみになる。
風俗に勤める少女の設定に少し違和感を感じる。
だが、一人娘を殺された母親が人生を引き換えにして犯人を追う痛ましさがそれを補ってあまりある。
国も司法も医者もマスコミも夫でさえ頼みにならず、たった一人で娘の命を奪った男にふさわしい罰を与えるために命をかける母親の姿はあまりにも痛ましい。
いとしい娘を失った母親の至極まっとうな思いを愚かしいとは言えまい。
物語は精神の病で苦しむ側の苦悩も同時に描いている。
そちら側の苦しみも存在する以上、人は行いを等しく裁かれるべきで、一方だけを放免するのは新たな苦しみの連鎖を生んでゆくだけだ。

この難しいテーマをごく普通の人の視点でわかりやすく描いたことがこの本の成功につながっている。
読みやすいのでいろいろな人に読んでもらいたい。

精神鑑定によって不起訴になった加害者、家族を殺された被害者と、その関係者、
といういくつもの視点で話が進んでいく。
非常によく構成されていて、混乱なく一気に読める。
加害者サイドの物語によって
刑法３９条について、単純な批判をするのではなく、意味を考えさせられるのが
この小説の優れた点だろう。
伏線も張り巡らされて、ミステリーとしても成立しているし、
それがすべて「刑法３９条」を考える材料になる。

人物たちが多少ステレオタイプだとは思うが、
これだけの内容と構成で１冊に収めたのだから仕方がないと思う。

私は特段に小説をたくさん読むわけではないのだが、
薬丸岳の作品は好きで呼んでいる。

今回は刑法３９条と言う、日本の刑法論点の王道部分が基軸テーマ。
もっとも「精神疾患と、どう向き合うのか？」というほうが、今作では重い感じがする。
登場人物の関連性や、最後付近で裏をかく手法は過去２作品に続き顕在で、
エグイ描写もありつつ、色々な事を投げかけて考えさせてくれる。
ただ過去２作品をと比べて、「ん？またこのパターンか」と思えてしまうところがあった。
（まぁそれが作者の味だと言ってしまえばそれまでなんでしょうけど。）

裁判員制度がはじまったら、民間人が刑法３９条問題ににぶち当たることが絶対あるはず。
専門書を読んだり、偉い人の話を聞くのは面倒で億劫だが、
本作のような小説を通して「自分だったらどう思うかな」と考えるぐらいは、
必要なんじゃないかな？　ただ感情論に流れないためにも。。。
もっと多くの人に読んで欲しい作品だ。
