法の社会的機能に対して、日本人の生活習慣、古来からの日本人の価値観をぶつけて考察されたもので、法に対する意識調査や戦時中の疎開時の実話、判例なども交えて書かれており、「法」というものを我々庶民の目線でかかれており、読みごたえがある。日本社会において「和の精神」や「喧嘩両成敗」すなわち「丸く納める」という社会関係の不確定性、非固定性の意識が、昔の裁判官ですら影響を受けた判決例などは、非常に興味深い。
近い将来日本でも裁判員制度が導入される。
そこで、不安に思ったのは、今もって「丸く納める」日本人が法の知識の有無以前に、果たして裁判員として機能するだろうかという危惧である。つまり、法という社会的機能を通しこして、人が人を裁くことになる、平たく言えば、好き嫌いで人が裁かれる怖さを考えさせられた。

筆者の川島武宜氏（1909-92）は敗戦後の日本を代表する民法・法社会学者。本書は昭和40（1965）年に東京でおこなわれた岩波市民講座をもとに書き改めたもので、きわめて読み易い。岩波新書青版を代表する本のひとつ。

本書は次のことを指摘する。すなわち、明治期に西洋から輸入した法制度と日本人の法意識にズレあるため、法が本来予期していない事象が起きている。具体的な事象とズレについて筆者の体験も含めた例証が挙げられており説得力に富む。本書の主張の趣旨が現代でも当てはまるところが多いことに驚きを感ずるとともに、これまでの約40年間に変わらなかった「意識」を実感することができ、古典を読む楽しさを発見できる。

筆者をはじめとする当時の知識人が共通に持っていたであろう「ある種の苛立ち」が垣間見えて面白い。その意味で学問思想史上の史跡との一つと思う。

「タテ社会の人間関係」（中根千枝）、「甘えの構造」（土居健郎）等と並ぶ日本論の名著。日本的法意識を「前近代的」と断じている点については今日では異論もあるかもしれないが、むしろ私はこのような素朴さはこの時代の日本論の長所だと思う。文化相対主義が陥りがちな思考停止から自由であったればこそ、こうした簡明な分析ができたのだろう。現代思想ブームは遠く去り、時代は本書の問題意識に回帰しつつある。現在行われつつある司法制度改革や自民党の憲法「改正」論議の基底にあるものを理解するためにも、今こそ読まれるべき名著である。
