ジョン・グリシャム初のノンフィクションである。実際にあった冤罪事件をドキュメンタリータッチで書き、アメリカの警察捜査の杜撰さ、裁判・陪審制度の問題点、冤罪被害者の救済の問題などを深くえぐっている。最近のグリシャムは不調なだけにどんなもんだろうと若干疑問に思いながら読み始めたが、途中からすっかり引き込まれて上下巻を一気に完読してしまった。

具体的には、オクラホマの片田舎で起こった殺人事件で、捜査官の決めつけ捜査により逮捕され、自白を強要された主人公が死刑判決を受けるまでの前半部分と、刑務所内で精神異常をきたしながら、死刑執行直前に再審が決定し、DNA調査により無実であることが判明、釈放されるという後半部分から構成されるのだが、特に考えさせられたのは一度死刑の判決が下されてから、それを覆すことがいかに困難かということである。人間心理としては当たり前のことなのかもしれないが、一度権威によって決められてしまったことを疑うということはなかなかできないこと。この事件の場合は良識を持つ関係者がいたから冤罪であることが立証されたのだろうが、この裏側には実際に死刑を執行されてしまった冤罪事件が山のようにあるに違いない。日本でも免田事件などたくさんの冤罪事件がかつてあったわけだが、対岸の火事ではない。ではどうやって冤罪を防ぐのかとなると、やはり事件の方向性をある程度決めてしまう警察捜査を担う担当官一人ひとりの意識が大事ということになるのだろうか。言うは易く行うは難しである。

米国の警察官はどうして自分の尺度でモノを判断するのだろうか？俺が法律だと言うことが前面に出てくるのだ。冤罪はこうして造られ、それを正すにはかくも時間がかかると言うことが描かれている。米国の暗黒面がここにあるのだ。
