   猟奇的な夫婦殺害事件が発生し、劇団員の柴田真樹（堤真一）が逮捕される。彼は殺害こそ認めるものの、殺意は否定。殺害当時の記憶はなかったと主張する。そして裁判中、人格が豹変したことから、司法精神鑑定が請求される。
   鑑定人・藤代実行（杉浦直樹）は、柴田が犯行時に精神が乖離状態で心神喪失していたと鑑定するが、鑑定助手の小川香深（鈴木京香）は、別の結論を確信し再鑑定に動き出す。多重人格の容疑者と、その精神の奥底に迫る鑑定者。徐々に事件の奥に潜む真実が明らかになっていく…。
 『失楽園』以来2年ぶりにメガホンをとった森田芳光監督が、当時の日本映画には珍しい、サイコ・サスペンスというジャンルに真っ正面から挑んだ作品。タイトルの刑法第三十九条とは、心神喪失者の行為は罰せず、心身耗弱者の行為はその刑を軽減するという法律で、容疑者・柴田にこの法を適用するか否かが劇中での焦点となる。　銀残しを使用した映像が終始憂うつな雰囲気を醸し出しており、眼鏡をかけた鈴木京香のナイーブな演技がより不安感を煽る。（斉藤守彦）

心神喪失者ノ行為ハ、罰セス
心神耗弱者ノ行為ハ、ソノ刑ヲ減軽スル

映画を観て久々に“全力疾走したあとのような感覚”を味わった。

堤真一と鈴木京香が素晴らしい。
堤真一は狂気と正気が渾然一体となる難しい役をみごとに演じ分け、
役者魂を見た。
鈴木京香は抑えた演技で多くを表現してさすが。
杉浦直樹や吉田日出子など脇を固める布陣も完璧。

森田芳光監督の最高傑作です。

刑法39条(心神喪失及び心神耗弱)「１.心神喪失者の行為は、罰しない。2. 心神耗弱者の行為は、その刑を減刑する。（現行どおり）」の是非について問う作品。主人公は高校生のときに、通りすがりの少年(15歳)に妹を殺害される。それから15年後、その殺人者は心神喪失状態であったという理由から罪に問われず、一般市民としての生活を送っている。それを知った主人公は、他人になりすまし、復讐を図る、というストーリーである。
　　刑法39条は、憲法11条（基本的人権の享有）「国民は、すべての基本的人権の享有を妨げられない。」を具体的に実現する方策のひとつとして、存続させる必要がある。しかし、.心神喪失者や心神耗弱者の刑の免除や減刑をもって事件の終結にすることは、犯罪者、被害者の人権を守ることにはならない。これが、鈴木京香が演じる精神鑑定人、小川香深の主張である。
　刑法39条の意義のほかに、精神鑑定の意義や信憑性、裁判長・検事・弁護士といった裁判に関わる人々の役割や心情、戸籍管理の不備や売買問題、偽装結婚、児童虐待、貧困家庭に対する保護など、この作品を通して多くのことを知り考えることができる。役者一同、重いテーマを真面目に演じ訴えかけており、好感が持てる。

最初から最後まで緊張感が途切れることなく、また、見る者を飽きさせずに見せます。
１４０数分の映画でこれはすごい事です。
凝ったカメラアングルや編集、銀残しの映像、役者達の演技などどれをとってもすばらしい。
森田監督の底力を見たような気がしました。
ディスクの画質・音質も優秀です。
